1 – Publisher

This website, accessible at www.firsh.law, is published by FIRSH Société d’Avocats, SELARLU, registered with the Paris Trade and Companies Register under number 949 421 192, with intra-Community VAT number FR14 949 421 192, whose registered office is located at 38 rue de Courcelles, 75008 Paris, France (“FIRSH”).

The publication director of the website is Ms Claire Poirson, in her capacity as managing director of FIRSH SELARLU.

FIRSH is a law firm specialising in intellectual property law, new technologies, artificial intelligence and impact projects. All FIRSH lawyers are registered with the Paris Bar and are therefore attached to the Paris Bar Association, France.

The lawyers who are members of FIRSH Société d’Avocats are subject to the internal rules of the Paris Bar and to the National Internal Regulations, in their applicable versions, as well as to the legislative and regulatory provisions governing the legal profession.

Respecting the principle that fees are freely determined, but committed to providing accurate prior information, FIRSH undertakes, beyond its legal obligations and in strict compliance with applicable professional rules, to ensure full and sincere clarity regarding the costs of its work, in accordance with the following rules:

  1. Provide prior information on the amount of retainers and fees, whether fixed or calculated by reference to time spent, or propose a fee agreement that may include a success fee.
  2. Formalise in writing a proposal for fees, costs and disbursements to be submitted for signature or approval by the client.
  3. Notify the client of any event likely to modify the amount initially anticipated due to the development of the matter.
  4. Provide, upon request, a detailed statement of the work performed.
  5. Where fees are calculated on a time-spent basis, issue invoices as work progresses and keep the client regularly informed.
  6. At the end of the assignment or upon closure of the matter, provide the client with a detailed account specifying the work performed and recalling all amounts requested.
  7. Display and make this charter available to clients in accordance with Article 10 of the RIU.

2 – Website content

The content of the website, including its general structure, text, images, whether animated or not, and sounds, is the exclusive property of FIRSH SELARLU. Any total or partial representation of this website and its content, by any means whatsoever, without the prior express authorisation of FIRSH SELARLU, is prohibited and would constitute infringement sanctioned by Articles L.335-2 et seq. of the French Intellectual Property Code.

3 – Licence to use website content

By connecting to the website, the user acknowledges acceptance from FIRSH of a licence to use the website content, strictly limited to the following mandatory conditions.

This licence is granted on a non-exclusive and non-transferable basis.

The right of use granted to the user is personal and private. Any reproduction of the website content on any medium for collective or professional use, even internally within a company, is prohibited. The same applies to any electronic communication of such content, even via a company intranet or extranet.

The right of use includes only authorisation to consult the website and its content.

This use includes only authorisation to reproduce the content for storage for display on a single-user screen and reproduction of one copy for backup and printing purposes. Any other use is subject to FIRSH’s prior express authorisation. Breach of these provisions exposes the infringer and all responsible persons to the criminal and civil penalties provided for under French law.

4 – Data protection – GDPR

FIRSH is the controller of the data collected on the website.

Users are informed that, in accordance with Article 32 of the amended French Data Protection Act of 6 January 1978, the information communicated through the forms on the website is necessary in order to respond to their request and is intended for the departments responsible for handling that request.

In accordance with Articles 39 and 40 of the amended French Data Protection Act of 6 January 1978, users have the right to access, rectify, update, port and erase information concerning them. They may exercise these rights by contacting contact@firsh.law or by post to FIRSH, 38 rue de Courcelles, 75008 Paris, France, indicating “Data subject rights” in the subject line and attaching a copy of their identity document.

In accordance with Article 38 of the same law, users may also object, on legitimate grounds, to their data being processed and, without justification and free of charge, to their data being used for commercial prospecting purposes.

Users are informed that the website www.firsh.law does not use cookies.

Users of the FIRSH website must comply with the provisions of the amended French Data Protection Act of 6 January 1978, breach of which may result in criminal penalties. In particular, with regard to any personal information they may access, they must refrain from any collection, misuse and, more generally, any act likely to infringe the privacy or reputation of individuals.

FIRSH trademarks that may appear on the website are registered trademarks. Any total or partial reproduction of these trademarks without the express authorisation of FIRSH SELARLU is therefore prohibited.

In the event of any dispute arising from your use of our website, the courts of Paris, France shall have exclusive jurisdiction.
